NORTHERN IRELAND

The law in Northern Ireland is not the same as mainland England and the use of metal detectors is covered by the Historic Monuments Act (NI) 1971 which states:

Part IV Section 11: A person shall not, save under and in accordance with a licence .....dig or excavate in or under any land ..... for the purpose of searching generally for archaeological objects ....

Part IV Section 12: The finder of any archaeological object ..... shall, within fourteen days of such finding, report the circumstances .... to the Director of the Ulster Museum .... or to the officer in charge of a police station.

OUTHERN IRELAND The National Monuments (Amendment) Act 1987 (Section 2) states:

Subject to the provisions of this section a person shall not:

1a: Use or be in possession of a detection device in, or at the site of, a monument of which the Commissioners or a local authority are the owners or guardians or in respect of which a preservation order is in force or which stands registered in the Register or

2a. in an archaeological area that stands registered in the Register or 3a. in a Registered area

OR

b: Use, at a place other than a place specified in paragraph a of this subsection, a detection device for the purpose of searching for archaelogical objects or

c: Promote, whether by advertising or otherwise, the sale or use of detection devices for the purpose of searching for archaeological objects.

Note: `Archaeological area' is defined as ` an area which the Commissioners consider to be of archaeological importance but does not include the area of a historical monument standing entered in the Register'.

Section 40 states that `Where in a prosecution for an offence under this section it is proved that a detection device was used, it shall be presumed until the contrary is proved that the device was being used for the purpose of searching for archaeological objects'.

Hej, dzieki za linka ale miałem na myśli bardziej poludniową irlandie. Pisałem do kilku osób lecz wiekszość zjechała do PL.

Trafilem w sieci na tekst który umieściłem poniżej, jest on umieszczony na kilku forach poszukiwawczych, ale nigdzie nikt nie wspomina o autorze. Czy ten tekst jest może oficjalnym stanowskiem jakiejś instutucji ?
Poznalem kilku farmerów z okolicy którzy nie maja nic przeciwko wejsciu na ich tereny. Boja sie tylko aby nie mieć problemów gdy Garda" spotka mnie na ich polu. Gdybym znalazł autora albo instutucje która to napisała dałoby to moze zielona swiatełko na okoliczne tereny i uspokoiłoby farmerów.
Wiem ze prawo jest dość restrykcyjne w IRL, lecz mam zamiar trzymac sie z dala na umowne 500m od obiektów historycznych.
Poprostu rekreacyjnie pośmigać po polach i plażach wokół Dublina.

The Law in Ireland
Here in the Republic of Ireland, the law is quite different. Nobody is allowed to search for archaeological artifacts with a metal detector, unless they have a license from the relevant State body. In practice, only qualified archaeologists are granted such a license. Due to the amount of heritage material which is reputed to have been illegally excavated and sold for profit, sanctions against those who break the Republic's laws are severe: a maximum of five years imprisonment and/or a fine not exceeding £50,000 on indictment.

Detectorists' Obligations
Government spokespersons have always assured the Metal Detecting Society of Ireland that it is not the intention of Government to be unreasonable in the treatment of detector hobbyists, provided they do not break the law. This assurance is reflected, to some extent, in the fact that a Garda may seize, without warrant, any detection device being used on or near archaeologically listed areas, but may not do so in any other area. This does not mean, however, that detectors may be used indiscriminately in all areas other than those listed as archaeologically significant; there are many undiscovered archaeological sites, and a detectorist who comes across such a site should report it within the statuary four days, and do nothing to interfere with it. The same requirement of reporting within four days also applies to any individual archaeological object found in the State.

Advice to Detectorists
Put simply, archaeology is best left to archaeologists. Hobby detectorists will always have plenty of beaches, parks, swimming areas, and other non-sensitive places to go 'coinshooting'. A responsible attitude must also be taken to the prohibition of detecting 'on', 'near', or 'in the vicinity of' prohibited areas. These terms are not defined in Law, and at a meeting with the Department of Art, Culture and the Gaeltacht, MDSI committee members suggested a 'safety limit' of one half kilometer from the outer boundary of any prohibited area. Department officials stated that they could not accept this as a voluntary code, as the terms 'at, near, or in the vicinity of' could only be properly interpreted in a legal context and on an individual basis.

The best advice we can give to Irish metal detector users is:

Do not detect anywhere near archaeological sites.
Do not detect on anyone's land without permission
Observe the basic courtesies of the countryside by closing gates and not damaging crops.
If you find an archaeological object - or site - report it immediately to your local Garda station or to the National Museum of Ireland. Phone 1890 MUSEUM (1890 - 687386)
If you are uncertain of the area you want to detect, contact your local Garda station for advice.

Chciałem zabrać z PL swoja xterrke ale mam pewne obawy przed rozpoczęciem poszukiwań w IRL.
Przekopałem sporo i znalazlem coś takiego w sieci :

jest to wycinek wiekszego pima apropo poszukiwań w IRL.

Czy ktoś zna autora tego tekstu ?

Mam kilka miejscówek pod dublinem gdzie farmerzy powiedzieli OK dla szukania, obawiaja sie tylko ze gdy przyłapie" mnie garda oni też bedą mieli problemy.
Gdyby okazało sie ze to 'pismo-tekst' jest oficjalnym uspokoiłoby to moich znajomków i zezwoliło na przeszukanie ich pól.


Ktoś ma jakieś pomysły ? Gdzie szukać autora ?
Przewija on sie po wilu forach lecz jest on tylko kopiowany bez podania żródła.

esku - spokojnie możesz to cytować. Upewnij się jednak, że właściciel terenu wie czy na jego ziemi nie znajdują się chronione stanowiska archeologiczne i najlepiej podaj mu do podpisania zgodę na poszukiwania. Pamiętaj też, że w przypadku znalezienia stanowiska, masz cztery dni na jego zgłoszenie, ale zrób to w porozumieniu z właścicielem. Nie wszystkich cieszy archeologia na ich ziemi ;-)
